Right of withdrawal for consumers
(A consumer is any natural person who concludes a legal transaction which, to an overwhelming extent, cannot be attributed to either their commercial or independent professional activities.)

Right of withdrawal
You have the right to withdraw from this contract within 14 days without specifying any reasons. The withdrawal period is 14 days with effect from the day:

• on which you, or a third party nominated by you who is not the carrier, have taken possession of the goods, provided you ordered one or more goods within the scope of a single order and this/these are delivered uniformly;
• on which you, or a third party nominated by you who is not the carrier, have taken possession of the last goods, provided you ordered several goods within the scope of a single order and these are delivered separately;
• on which you, or a third party nominated by you who is not the carrier, have taken possession of the last part delivery or the last unit, provided you ordered goods that are delivered in several part deliveries or units.

To exercise your right of withdrawal, you must inform us (EvoBrands GmbH, Zum Galgenknapp 32, 33378 Rheda-Wiedenbrück, telephone number: +49 5242 9939003, e-mail address: mail@zukono.de) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, which is, however, not mandatory.

You can also declare your withdrawal directly online using our online withdrawal form. If you use the form, we will immediately send you a confirmation of receipt on a durable medium (e.g. by e-mail), including the content of your withdrawal declaration and the date and time it was received.

In order to safeguard the withdrawal period, it is sufficient that you send the notification about the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the withdrawal
If you withdraw from this contract, we shall repay all payments which we received from you, including the delivery costs (with the exception of additional costs which arise from the fact that you selected a form of delivery other than the most reasonable standard delivery offered by us), immediately and at the latest within 14 days from the day on which we received the notification about your withdrawal from this contract. For this repayment we use the same means of payment which you used during the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees owing to this repayment.

We can refuse the repayment until the goods are returned to us or until you have furnished evidence that you have sent the goods back to us, depending on whichever is earlier.

You must return or hand over the goods to us (Return address: März Fulfillment Services, c/o Zukono, Gut Heinrichshof 12, 22969 Witzhave) immediately and, in any case, at the latest within 14 days with effect from the day on which you inform us of the withdrawal from this contract. The deadline is maintained if you send the goods before the expiry of the 14-day deadline.

You bear the direct costs of returning the goods.

You must pay for any depreciation of the goods only if this depreciation can be attributed to handling of them by you that was not necessary for checking the condition, features and functionality of the goods.

Criteria for exclusion or expiry
The right of withdrawal is not available for contracts

• for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or stipulation by the consumer is decisive, or which are clearly tailored to the personal requirements of the consumer;
• for the delivery of goods that can spoil quickly or whose use-by date would be exceeded quickly;
• for the delivery of alcoholic drinks whose price was agreed at the time of concluding the contract, which however can be delivered 30 days after the conclusion of the contract at the earliest and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
• for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

• for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after the delivery;
• for the delivery of goods if, after the delivery and owing to their condition, they have been inseparably mixed with other goods;
• for the delivery of sound or video recordings or computer software in a sealed package if the seal has been removed after the delivery.

Grounds for expiry
The right of withdrawal expires in the case of a contract for the supply of digital content not on a tangible medium that obliges the consumer to pay a price if the consumer:

1. has expressly consented to the entrepreneur commencing performance of the contract before the end of the withdrawal period; and
2. has confirmed their awareness that their right of withdrawal expires upon the commencement of performance of the contract; and
3. the entrepreneur has provided the consumer with a confirmation of the contract on a durable medium which reproduces the content of the contract and records that the consumer expressly consented, prior to performance of the contract, to the entrepreneur commencing performance before the expiry of the withdrawal period and confirmed their knowledge that, by consenting, they lose their right of withdrawal upon commencement of performance of the contract.
